                                ORDINANCE NO. 9768
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO DELETE CONDITION NO. 1 IN ORDINANCE 9716,
                   RELATIVE TO THE ERECTION AND MAINTENANCE OF A
                   SIGHT-OBSCURING FENCE AND INSERT IN LIEU
                   THEREOF A NEW CONDITION NO. 1.

              	   WHEREAS, it has been determined that there is a need
         to amend conditions to the Chattanooga Zoning Ordinance,
         Ordinance No. 6958, as amended so as to delete condition No. 1
         in Ordinance 9716, encaptioned, "AN ORDINANCE TO AMEND 
ORDINANCE
         NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO
         REZONE A TRACT OF LAND LOCATED AT 3901 DODDS AVENUE, BEING ON
         THE NORTHWEST LINE OF DODDS AVENUE AT EAST 39TH STREET, FROM 
R-2
         RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO 

         CERTAIN CONDITIONS.";
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, 
the
         Zoning Ordinance, be and the same is hereby amended as follows:
              	   SECTION 1.	  That Article V Section II be amended by
         deleting subsection (1):
        
              	   "(1)	Erection and maintenance of a sight-obscuring
         fence along the west line of the property." and inserting in
         lieu thereof a new subsection (1) to provide:
        
              	   "(1) The existing natural growth shall be maintained
         as a screen along the west line of the property."
        
         	   SECTION 2.	  BE IT FURTHER ORDAINED that this
         Ordinance shall take effect two weeks from and after its 
passage
         as required by law.
